Pitched In respects copyright, and our whole Service depends on it. This policy explains how to report content on the Service that you believe infringes your copyright, how the person who sent it can respond, and what happens to repeat infringers. It follows the US Digital Millennium Copyright Act (17 U.S.C. § 512), and we handle complaints from every country the same way.
1Our designated agent
Send copyright notices to our designated agent:
Copyright Agent, Pitchedin App LLCMiami, Florida, United StatesEmail: copyright@pitchedin.app
Our agent is registered with the US Copyright Office's DMCA Designated Agent Directory.
2Reporting infringement (a takedown notice)
Your notice must include all of the following, in writing:
- Your physical or electronic signature. You may sign as the copyright owner or as someone authorised to act for them.
- The copyrighted work you say is infringed. If there are several, give a representative list.
- The material you say infringes, with enough detail for us to find it. For example: the song's title, the composer's name, the date it was sent, and the A&R inbox it was sent to (if you know them).
- Your name, address, phone number and email.
- A statement that you have a good-faith belief that the use isn't authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate. You must also state, under penalty of perjury, that you are the owner or authorised to act for the owner.
Pitched In is private: songs are only visible to the composer and the A&Rs they were sent to. If you can't identify the material precisely, tell us what you know and we'll work with you.
What we do: when we receive a valid notice, we:
- remove the material or disable access to it promptly;
- tell the person who sent it, with a copy of the notice (we may remove the complainant's personal contact details);
- record the complaint against their account.
3Responding (a counter-notice)
If your content was removed and you believe that was a mistake or a misidentification, you may send our agent a counter-notice. It must include, in writing:
- Your physical or electronic signature.
- The material that was removed, and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification.
- Your name, address and phone number.
- A statement that:
- you consent to the jurisdiction of the US federal district court for your address (or, if you're outside the United States, any judicial district where Pitched In may be found);
- you will accept service of process from the person who sent the notice, or their agent.
What we do:
- We send your counter-notice to the person who sent the original notice.
- We restore the material 10 to 14 business days after we receive the counter-notice, unless they first tell us they've filed a court action to stop the infringement.
4Repeat infringers
We close the account of anyone who repeatedly infringes copyright. That generally means two or more valid notices against an account that weren't successfully countered. We may close an account sooner in clear or serious cases.
5False claims
Under US law (17 U.S.C. § 512(f)), anyone who knowingly makes a material false statement in a notice or counter-notice may be liable for damages. That includes costs and legal fees. Please check that the material really infringes, and consider fair use, before sending a notice.
6Disputes between collaborators
Some disputes are about who owns a song rather than about copying, for example between co-writers. We can't decide those. We may remove the content while the parties resolve the dispute, and we'll restore it if they agree or a court orders it.
